IV. President’s Report
  A.  From KU Faculty Senate President Tom Mulinazzi:
"Librarians (at KU) are evaluated the same as tenured track faculty. Outside reviewers are required  About 80% of the evaluation is based on their library activities About 20% is based on their scholarly activity and professional service"
     
  B. Kansas Board of Regents meeting,  November 13 - 14, 2002
   
  C. Vice President & General Counsel Ted Ayres will be meeting with the Faculty Senate Executive Committee on November 18. We will discuss the issue of policy changes suggested by the Faculty Senate; hopefully this discussion will help improve and facilitate the process under which Faculty Senate initiated policy changes are approved and implemented.
   
   D.  Proposed Mandatory External Review Schedule:
With respect to any faculty policy, the Faculty Senate has the responsibility to approve any changes, subject to the authority of a meeting of the general faculty to make final (faculty) decisions. However, certain standing committees can provide information which the Faculty Senate may find useful. One such committee is the Faculty Affairs Committee; Professor Joyce Cavarozzi, chair of this committee, will present the committee's comments on external reviews today. Another such committee is the University Tenure and Promotion Committee. I propose to invite some former members of this committee to speak to the Faculty Senate at the November 25 meeting on the topic of external reviews. Should the Senate wish to hear from any other committee or group, I will attempt to fulfill the Senate's wishes; if the Senate feels it has sufficient information, it is free to discuss and vote on motions related to external reviews at its pleasure. 
   
  E.  Due to the crowded agenda and the upcoming executive committee meeting with Vice President Ayres, for each policy item to be considered under old business, I humbly request that the Faculty Senate either reach a prompt decision or table the discussion on the item. Our discussion with Vice President Ayres might help resolve or clarify some issues of concern to the Faculty Senate.

V. Committee Reports

  B.  Library Committee -  Phillip Parker, Chair
       The Faculty Senate Library Committee urges the Faculty Senate to adopt the following motion:

      "The Faculty Senate of the Wichita State University regards the USA PATRIOT Act (2001) as a threat to the rights of the faculty, staff, and students since the legislation undermines the confidentiality that is necessary for the flow of information within a university. We urge higher education and the nation's leaders to implement the legislation in a way that will protect our civil liberties while still assuring greater national security."

A patron cannot be told that his or her records were given to the FBI or that he or she is the subject of an FBI investigation.  Overrides state library confidentiality laws protecting library records.

VI.

Old Business

  A.  Use of Cell Phones & Pagers:  The Faculty Senate approved and sent forward the following policy:
        "Cell phones and pagers will not be operated or used by students during class times.  Faculty may approve an exception for special circumstances (e.g. emergencies)."
         The Administration responded with following suggested language:
        "Student cell phones and pagers must be turned off during class times.  Faculty may approve an exception for special circumstances"
   
  B.  Policies & Procedures Manual policy 4.11 / Terminations (Faculty Handbook policy 3.10) currently reads:

   "In cases of termination of tenured faculty not involving termination for cause, the university has the obligation to make every effort to find a suitable position within the institution for the affected faculty member. The suitability of any proposed position shall be by mutual agreement of the faculty member and the receiving department or equivalent unit. Faculty relocated within the university will not automatically, by virtue of their tenure, displace tenured, probationary or temporary faculty within the receiving department or equivalent unit."

    
The administration apparently requested and Faculty Senate President Carroll stated that she approved new wording of the first sentence of this policy so it reads:

    "In cases of termination of tenured faculty not involving termination for cause, the university has the obligation to make an effort to find a suitable position within the institution for the affected faculty member."

    The current Faculty Senate Executive Committee objects to this language and prefers either the original language or the following language:

    "In cases of termination of tenured faculty not involving termination for cause, the university has the obligation to make every reasonable effort to find a suitable position within the institution for the affected faculty member."

    
The Executive Committee decided to refer this item to the Faculty Senate for its action.
   
  3.  Faculty Affairs Committee comments --Professor Joyce Cavarozzi will provide comments from the Faculty Affairs committee on external peer reviews.

VII. New Business
A Motion from the Library Committee - Senator Parker will present the Library Committee's motion.  see committee reports-B)  At the request of some members of the Executive Committee, Director of EEO & Assistant Counsel Leonard Clark has tentatively agreed to research the USA PATRIOT Act and to present an independent view of the impact of this act on higher education to the Faculty Senate at a future meeting this fall. The Executive Committee requests that final action on this item be postponed until the December 8 meeting or until Mr. Clark can attend and present his findings, whichever comes first.
